Labour History, 69. 188-195   http://search.informit.com.au/fullText;dn=960807826;res=IELAPA   Briefly describe the Aboriginal Protection and Restriction of the Sale of Opium Act, 1897   Identify several key elements of the Aboriginal Protection and Restriction of the Sale of Opium Act, 1897.   Choose one element of the Aboriginal Protection and Restriction of the Sale of Opium Act, 1897 and reflect and discuss the implications that are still evident or relevant today.  Answer The Aboriginals Protection & Restriction Of The Sale Of Opium Act- 1897 The Parliament of Queensland has amended this Bill- Victoriae Regiae No. [17] to enhance the better protection and care of the Aboriginal people as well as half- caste inhabitants of the colonies and also to make effectual regulation for restricting the distribution of Opium. This was the first act that was implemented in Victoria and/or New South Wales to restrict the consumption of opium by Aboriginals as it could cause greater injuries to them (SLQ, 2016). The significant reduction in the number of Aboriginals because of dispersal, malnourishment, opium use and diseases along with insufficient opium use regulation; has motivated the Government to amend this Act.           Victoriae Regiae No. [17] has given varied elements of the Act as: 1) Superintendents should be appointed; 2) Reserves should be subjected to regulations; 3) Aborigines might be moved to reserves; 4) People prohibited from entering the reserve (except Aborigines, Superintended and/unauthorized people); 5) Aborigines might be employed and supervised, particularly females; 6) Duration of stay, renewal with renovation of reserve-permit; 7) Penalty for supplying or being a cause for supplying liquor (except bond-wide medical purposes) to Aborigines; 8) Persons supplying opium should be guilty of the punishable offence with penalty (Light, 2014); 9) Penalty for possession and/or sale of opium unlawfully by certain persons; 10) Premises might be searched for opium that are believed to be kept contrary to Act-provisions. The element of supervising employed Aborigines and half-caste inhabitants is taken for discussion. As per 1897 Act, the employment of Aborigines should be strictly controlled by the Regional and later by Chief Protectors (SLQ, 2016). The employers should get permission from the Protectors to employ Aborigines by entering into an agreement with Aborigines in-front of a Justice/police-person (Holland, 2013). This agreement should include details about the wages, employment conditions with the employee and employer’s names. In 1901, the employers were directed to pay Aboriginal wages to the Protector/police-officer, which were kept in an account on behalf of Aborigines. The 13th Section of 1901 Act has given rights to the Protector to manage the properties of Aboriginals which has increased their money and property (Queensland-legislation, 2017a). The 1904 Regulation has permitted the estates of dead natives and unclaimed funds to be paid in Aborigines protection properties account. The Aboriginal Provident-Fund (1919) and later Island Fund (1912) have enhanced the Aborigines livelihood. Queensland-legislation (2017a) stated that the 1897 Act was revised as Aboriginals preservation with protection Act (1939) in which the Director for Native affairs should act as the legal guardian for under-21s aboriginals and should give permission to employ them. This was replaced by 1965 Act of Aboriginals & Torres-Strait Islanders-affairs to enhance the progressive development of Aboriginals by appointing ‘assisted Islander’ which was later transformed to Torres-Strait Islander’s Act- 1971, Community Services Act- 1984 and the Aboriginals & Torres-Strait Islander’s Community- 2014 to promote justice, land with other matters (Queensland-legislation, 2017b). Thus, the 1897 Act has transformed the lives of the Aborigines, a several times better than before.
